TERMS OF SERVICE

By accessing or using BigTruckSales.ai (the "Site"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Site.

These Terms apply to all users, including dealers, private sellers, buyers, and visitors. By creating an account or posting a listing, you represent that you are at least 18 years old and authorized to enter into these Terms.

BigTruckSales.ai is an online marketplace and dealer operating system that connects buyers and sellers of commercial trucks, trailers, and parts. We provide tools for listing, searching, valuing, financing, insuring, transporting, and inspecting commercial vehicles.

We act as a marketplace platform and are not a party to any transaction between buyers and sellers. We do not take possession of vehicles, process payments between parties, or guarantee the completion of any sale.

Certain features — including dealer subscriptions, featured listings, banner advertising, and AI tools — are offered as paid services with pricing described on our Pricing page.

To access certain features, you must create an account and provide accurate, complete, and current information. You are responsible for safeguarding your password and for all activity under your account.

You agree to notify us immediately of any unauthorized use of your account. We may suspend or terminate accounts that violate these Terms or that we believe are engaged in fraudulent or harmful activity.

Each account is tied to a single user or business entity. Sharing login credentials across multiple users is prohibited.

Sellers are solely responsible for the accuracy of all information in their listings, including vehicle specifications, condition, mileage, VIN, title status, and pricing. Listings with misleading, false, or fraudulent information may be removed without notice.

By posting a listing, you represent that you have legal title or authority to sell the vehicle, that the vehicle is free of liens or encumbrances not disclosed in the listing, and that the sale will comply with all applicable federal, state, and local laws.

Sellers agree to respond to inquiries in good faith, honor advertised prices and terms, and complete transactions as agreed. BigTruckSales.ai is not liable for a seller's failure to deliver a vehicle or a buyer's failure to pay.

We reserve the right to review, reject, or remove any listing at our discretion, and to limit the number of listings per account.

Buyers are responsible for conducting their own due diligence before purchasing a vehicle, including inspecting the vehicle, verifying the title and VIN, and reviewing the seller's reputation.

BigTruckSales.ai offers optional pre-purchase inspection services through our partner InspectTheTruck.com. Purchasing an inspection does not constitute a guarantee of vehicle condition.

Buyers agree not to submit fraudulent inquiries, spam sellers, or attempt to circumvent the platform to avoid fees.

We provide referrals and integrations to third-party ecosystem partners for financing (TruckFinancing.ai), insurance (MyTruckInsurance.ai), transport (TruckTransport.ai), and inspections (InspectTheTruck.com).

These partners are independent businesses with their own terms, underwriting criteria, pricing, and privacy policies. BigTruckSales.ai does not guarantee approval, pricing, or service quality from any partner.

By submitting an application or quote request, you authorize us to share your information with the relevant partner so they can fulfill your request.

Paid subscriptions and add-on products are billed through Stripe on a recurring basis (monthly or annually) until cancelled. By subscribing, you authorize us to charge the listed price to your payment method each billing cycle.

You may cancel your subscription at any time from your account settings. Cancellations take effect at the end of the current billing period — no refunds are issued for partial billing periods.

We may change subscription pricing with reasonable advance notice. Existing subscribers will be charged at the rate in effect at the time of renewal unless they cancel before the renewal date.

Listing fees, if applicable, are non-refundable once a listing is published.

You agree not to: (a) use the Site for any unlawful purpose; (b) post fraudulent, misleading, or inaccurate listings; (c) impersonate another person or business; (d) scrape, copy, or redistribute listings or data without permission; (e) interfere with the Site's operation or security; (f) attempt to reverse engineer or disrupt our systems; (g) use bots or automated tools to submit inquiries or listings; or (h) circumvent platform fees by completing transactions off-platform.

Violations may result in account suspension, listing removal, and forfeiture of paid fees without refund.

The Site, its design, branding, content, and software are owned by BigTruckSales.ai and protected by intellectual property laws. You may not copy, reproduce, or distribute our content without permission.

Listings, photos, and content submitted by users remain the property of the user. By posting, you grant BigTruckSales.ai a non-exclusive, royalty-free license to display and use that content for the purpose of operating and promoting the marketplace.

The Site is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Site will be uninterrupted, error-free, or secure.

We do not guarantee the accuracy of listings, vehicle valuations, market data, or AI-generated content. All information should be independently verified before relying on it for a purchase decision.

AI tools and market intelligence features provide estimates and suggestions only — they do not constitute professional, legal, or financial advice.

To the maximum extent permitted by law, BigTruckSales.ai shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or any transaction conducted through it.

Our total liability for any claim arising from these Terms or your use of the Site is limited to the amount you paid us in the preceding 12 months, or $100, whichever is greater.

We are not liable for the actions or inactions of buyers, sellers, or ecosystem partners.

You agree to indemnify and hold harmless BigTruckSales.ai, its officers, employees, and partners from any claims, damages, or expenses (including legal fees) arising from your listings, your use of the Site, or your violation of these Terms or applicable law.

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Any dispute arising from these Terms or your use of the Site shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to binding arbitration in Florida, except for claims that may be taken to small claims court.

You waive your right to participate in a class action or class-wide arbitration.

We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or conduct we deem harmful to the marketplace. You may close your account at any time by contacting support.

Upon termination, your listings will be removed and your data retained per our Privacy Policy and legal obligations.

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use of the Site after changes constitutes acceptance of the revised Terms.
